In this work, the principle of separation of powers is considered in three aspects: as an ideological and worldview principle underlying the theory of the social contract; as a theory and an element of the methodology of social sciences; as a political and legal structure behind the design of political systems. It is argued that at the applied level, the most productive is the understanding of the separation of powers as the principle of the optimal structure of the state apparatus, in which the functions and powers of the state as the bearer of a single authority are rationally distributed among the state bodies of the three branches of government. The theoretical grounds for determining the legislative branch of government as a fundamental, as a priority have been considered. It is noted that there are currently not enough theoretical grounds for singling out one of the branches of government as a priority.
